QUEEN CALIFORNIA PAGEANT 2016 APPLICATION

  • ELIGIBILITY REQUIREMENTS

    To be eligible to compete in the Queen California Pageant, you must be:

    • 21 years old or older on or before the submission of this application
    • A transgender and/or gender non-conforming individual
    • In good physical and mental health and capable of performing the duties of the Titleholder, as set forth in the Queen USA application, located at www.transnationfestival.org
    • Able to travel all the obligations and and meet the time commitment required of the Queen USA Titleholder, as set forth in the Queen USA application
    • A current resident of the state of California
    • A supporter of transgender health and human rights
  • All interested applicants must electronically submit the below application and ALL supplemental materials by 11:59 p.m. PST on September 1, 2016.  A submitted application does not guarantee acceptance as a contestant nor placement in the event. Queen California Pageant reserves the right to decline any submitted applications.  Decisions will be final and cannot be challenged or used as a basis for a claim or litigation. Accepted applicants will be notified by email no later than September 5, 2016. Below are the six steps in the application process.  Please have all of your supplemental materials and information prepared BEFORE you begin submitting your application online.
    1. APPLICANT INFORMATION: Complete the general information portion of the application form.
    1. PROOF OF RESIDENCY: Applicant must be a current resident of the state of California. Please upload ONE document that provides proof of your California residency. Please note that the document must be from within the last six (6) months. Please black out any private information (other than your name and address). Applicant may be contacted to provide further verification. Examples of satisfactory proof include:
    •  Voter registration card
    • Paycheck stub OR letter of employment verification on company letterhead (signed by a manager of the personnel department)
    • Driver’s License OR State/Government ID card
    • Marriage license or divorce decree
    • License or certificate issued by the State (with issue & expiration dates)
    • Utility bill (electrical, gas, telephone, cable - all utility bills count as one proof)
    • Tax Bill
    • State Aid or Social Welfare
    • Car registration and/or car insurance
    • Federal or State issued Letter or Records
    • Vehicle Records
    • University, college or school ID

    • Contestant and Applicant grants Queen California, Queen USA, TransNation Festival, St. John's Well Child and Family Center, Inc. (collectively, “Licensees”), a royalty free, paid up, perpetual, irrevocable, worldwide license, right and permission to reproduce, publish, distribute, prepare derivative works from and otherwise use the photograph and Contestant’s and Applicant’s image, identity, name, signature and other identifying characteristics in any format, size, or media for advertising, promotional and other purposes relating to the Queen USA pageant or the TransNation Festival. Contestant and Applicant grant of license, right and permission applies to any and all rights that Contestant and Applicant may have under any and all applicable laws including, by way of example and not limitation, copyright, trademark rights and rights of publicity. Contestant and Applicant warrants and represents that Contestant and Applicant has all necessary rights and permissions to grant these licenses, rights and permissions. Contestant and Applicant agrees to defend and indemnify Licensees and their officers, directors, employees, volunteers and agents against any third party allegation, claim or lawsuit arising out of or relating to Licensees exercising, exploiting or otherwise using these licenses, rights and permissions.
    Photographs may also be used for the application review process, preliminary judging, and print/video materials related to the event. NOTE:  All photographs and videos submitted become property of the Queen California Pageant.

    NOTE:  In this application, the terms below have the following meaning:

    • The pronouns “they” and “theirs” refer to the Applicant, Contestant and/or Titleholders.
    • “Applicant” refers to the person submitting the application.
    • “Contestant” refers to the accepted Applicant.
    • “Titleholder” refers to the Queen California winner.
    • “Producer(s)” refers to the Producers of Queen California pageant and their sponsor,
  • 1. Queen California 2016 Titleholder is required to return to the 2017 Queen California Pageant to crown the Queen California 2017 winner.
  • 2. Queen California 2016 Titleholder is required to participate in Queen California scheduled appearances between September 24th 2016 and the 2017 scheduled Queen California Pageant date. (The term “Appearances” is defined within the below section of the pageant application entitled “Appearances”.)
  • 3. Titleholder agrees to participate in a cooperative and timely manner in media interviews, either in-person, by phone, or in writing, to support Queen California PR efforts.
  • 4. Titleholder may accept or continue employment not related to that of Titleholder and may be a party to contracts relating to their personal services, including a talent agency contract, modeling contract, or theatrical contract, provided however, that such employment or contracts shall not: 1) Authorize, require, or permit the use of the name Queen California nor make any reference to Titleholder’s participation in the USA pageant. 2) Include any endorsement or commercial tie-in based on Titleholder’s image, likeness, or name. 3) Interfere in any way with their obligations as Titleholder.
  • 5. If the Queen USA 2016 Titleholder is deemed by the Queen USA pageant and TransNation Festival Producers to be neglectful of their duties or disqualified for any other reason per the pageant rules and regulations, or if the Titleholder forfeits their title, any outstanding prize money due to the National Titleholder will be forfeited and the title will be assigned to the 2nd Place Winner. If the 2nd Place Winner is unable to assume the title, the crown will be passed to the 3rd Place Winner. All appearance requirements and duties of the Queen USA National Titleholder will then apply to either the 2nd Place Winner or 3rd Place Winner, as the case may be. The new Titleholder shall meet and discuss with the Queen USA pageant and TransNation Festival Producers to determine their duties, Appearance requirements, etc.
  • Statement of Understanding & Commitment Requirements: To be eligible as a Contestant I understand and agree that:
      • The QUEEN California pageant will take place on September 24, 2016 at the Doubletree Hotel in Los Angeles, CA.
     
    • The Producers reserve the right to refuse to admit any applicant into the pageant.
       
    • I will be held responsible for my own medical, liability and any other form of insurance as well as any expenses, obligations or responsibilities of any kind arising out of any health or medical issues or injuries before, during, and after the pageant.
       
    • I will be held responsible for my own actions and interactions before, during and after the pageant. I understand that by my involvement in the pageant, I am representing QUEEN California. Therefore, I agree to not participate or promote any actions or activity during the pageant, that would reflect poorly upon the Pageant, including but not limited to, illegal activities, use of illegal or un-prescribed substances, public intoxication, physical altercations, disparaging comments about the pageant, contestants and all parties associated with the pageant and I agree to adhere to the Code of Conduct to the fullest extent.
       
    • I am at least 21 years old.
       
    • I identify as transgender and/or gender non-conforming.
       
    • I, nor my immediate family, are not an Employee of the Sponsors or Judges, their parent companies, subsidiaries, representatives, and advertising/promotion agencies.
       
    • I have read, understand and agree to the eligibility requirements, selection process, duties of the pageant winner and finalists, semi-finalist package information, event descriptions and overview.
       
    • I understand and agree that even if initially selected as a Contestant, this does not validate or confirm my eligibility as a Contestant. I may be required to verify and provide additional information to determine my eligibility leading up to and during the Pageant. I agree to cooperate and provide any additional information, approval and/or authorization to Queen California Pageant and their Producers to determine my eligibility.
       
    • The Queen California Pageant, and their Producers, shall determine all issues regarding my eligibility to compete in the Queen California Pageant. I agree to abide by the eligibility determination regarding myself and other applicants.
       
    • I am in good health both physically and mentally and I am able to perform the professional responsibilities of the Titleholder.
       
    • If selected as a Titleholder, I will continue to hold said title granted until my successor is selected or appointed.
       
    • If selected as Titleholder, I will receive a total prize of $1000. This prize will be awarded as follows: I will receive $750 as a cash prize by November 10th, 2016, and the remaining $250 will be paid upon crowning the Queen California successor by December 31, 2017.
       
    • If selected as a Contestant, I agree to participate in all the activities that are currently listed under the Queen California web site, and any subsequent changes or modifications that are deemed necessary by Queen California. I also acknowledge that I will be responsible for my own wardrobe, make-up, and other items/materials/equipment needed for my participation in the pageant. While there may be makeup and wardrobe professionals at the pageant, I will not have access to them unless the pageant has provided them or given express approval.
       
    • If selected as a Contestant, I will attend the Queen California Pageant National Competition and will attend and be on time for ALL pageant events, including, but not limited to rehearsals, VIP dining engagements, the pageant after party, publicity engagements, and on-stage and off-stage photos, as a fully engaged participant. I will not leave the venue of the final competition until the conclusion of the pageant event and after party and will be present on-stage during all required times. This includes all stage appearances before and after the finalists have been announced and on-stage photos of the finalists following the conclusion of the production and during all pageant-related events.
       
    • If selected as the Titleholder and I am unable to compete in the USA Pageant FOR ANY REASON, I will forfeit my State Title and there are NO REFUNDS under any circumstances. Nor are funds transferable
       
    • If selected as a Contestant in the Queen California pageant and I am unable to compete FOR ANY REASON, I understand and agree that there are NO REFUNDS under any circumstances. Nor are funds transferable.
       
    • Refunds: I understand and agree that in the event the Queen California Pageant determine I am ineligible and/or not allowed to compete in the California Pageant, I will not be entitled to any refunds whatsoever. Indeed, under no circumstance and for no reason shall I be entitled to a refund, in whole or in part, for any fees paid. All fees paid to the Queen California Pageant are non-refundable and non-transferable, without exceptions. This includes, but is not limited to entry fees, advertising fees, application fees, program book ads, pageant admission tickets sales fees, guest meal fees, extra event fees, crown and sash fees, special award fees, and any other fees paid to Queen California Pageant by you or on your behalf by any other party.
       
    • There may be changes to the pageant format, rules, regulations, scheduled activities, policies, or other pageant related things and events as deemed necessary by Queen California Pageant and TransNation. By entering the pageant, I agree to abide by any and all changes made.
       
    • Queen California Producers may create a biographical sketch (BIO) from my submitted information for the festival and pageant website and promotional materials. Contestant grants Queen California a royalty free, paid up, perpetual, irrevocable, worldwide license, right and permission to use the information specified above, and similar information, for the purpose specified and similar purposes.
       
    • Crowns and sashes remain the property of the Queen California Pageant until after the following year’s national competition. Any Contestant that defaults on their contract or does not attend the USA Pageant must return all prizes, crown and sash to the Queen California Producers in the condition in which it was initially given to the Contestant.
         
    • I understand and agree to assist in the promotion and publicity of the pageant and agree to participate in interviews, commercials or other such promotional events if Queen California ask for my participation. Furthermore, I agree that I will not be compensated for any such participation, as it is a condition to my eligibility to participate and compete at the Queen California Pageant.
       
    • I understand and agree that I may withdraw from the competition at any time, however, in doing so, I will return my sash to the Queen California Pageant. Under no circumstance and for no reason shall I be entitled to a refund in whole or in part of any fees paid. All fees paid to the Queen California Pageant are non-refundable and non-transferable with no exceptions. This includes, but is not limited to entry fees, advertising fees, pageant admission tickets sales fees, guest meal fees, and any other fees paid to the Queen California Pageant by anyone including, but not limited to the Contestants, sponsors, family members and advertisers. All licenses, rights and permissions granted by contestant or applicant shall survive and continue after any withdrawal from the competition.
       
    • Any misconduct, negative innuendoes or misrepresentations by me (or anyone acting with or under my authority) in any form, be it oral, written and/or through actions or conduct, will be grounds for disqualification, without question or right to appeal.
       
    • The Queen California Pageant Producers have the right at the discretion of The Queen California Pageant, or the Producers, to revoke the Titleholder’s position at any point during their reign if the Titleholder neglects their duties, violates pageant rules and regulations or by either act or omission has (i) brought themselves into widespread public disrepute, contempt, scandal or ridicule which has a materially adverse effect on the brand or reputation of The Queen California Pageant, or the Producers or sponsors; or (ii) offended the community or a significant portion thereof and caused a material reduction in the value of the brand or reputation of The Queen California Pageant, or the Producers or sponsors. Should that happen, all winnings must be immediately refunded to the Producers by the Titleholder.
       
    • I am not a party to any contract, whether written or oral, with any person, firm, business, Public Relations Firm, publicist, charity, corporation or any other legal entity with respect to any present title that I hold or may hold, nor have I made any commitments for the future regarding any such titles.
       
    • Contestant and Applicant grants Queen California Pageant (“Licensee”), a royalty free, paid up, perpetual, irrevocable, worldwide license, right and permission to reproduce, publish, distribute, prepare derivative works from and otherwise use the photograph and Contestant’s and Applicant’s image, identity, name, signature and other identifying characteristics in any format, size, or media for advertising, promotional and other purposes relating to the Queen California pageant or the TransNation Festival. Contestant and Applicant grant of license, right and permission applies to any and all rights that Contestant and Applicant may have under any and all applicable laws including, by way of example and not limitation, copyright, trademark rights and rights of publicity. Contestant and Applicant warrants and represents that Contestant and Applicant has all necessary rights and permissions to grant these licenses, rights and permissions. Contestant and Applicant agrees to defend and indemnify Licensees and their officers, directors, employees, volunteers and agents against any third party allegation, claim or lawsuit arising out of or relating to Licensees exercising, exploiting or otherwise using these licenses, rights and permissions.
       
    • ARRIVAL DATE:  I will arrive at the host hotel no later than 10am on Saturday, September 24th, prepared for active participation in scheduled pageant rehearsals and events.
       
    • I will be on time for ALL rehearsals and events. I understand that roll call will be taken at the beginning of rehearsals and events.
       
    • During their reign, all contestants agree to be loyal to the Queen California Pageant and give their time and energy to the pageant title and only that title. Indeed, this is the Titleholders’ main priority. Further, the Titleholder will not promote verbally, in writing, on any social media or through any other forum any other pageant title(s) or pageant system(s).
       
    • If chosen as a State Titleholder, I will proudly represent my title and attend all required meetings and events and will conduct myself at all times with dignity, grace and good manners.
       
    • If chosen as a Titleholder, I will embrace and proudly promote the title through the end of the following year’s Pageant Competition.
       
    • If I am selected as a Titleholder, the Queen California Pageant Producers are given the right and power, with respect to all Appearances required under this agreement, to control and make arrangements for all of my publicity engagements and interviews, including but not limited to all decisions concerning production, promotions, photographs, advertising, program, media, social media, endorsements, testimonials, appearances, and all other aspects of the Queen California Pageant , as well as promotions throughout my reign, to be designated solely at the discretion of the Queen California Pageant Producers.
    • If I am selected as a Titleholder and I have or obtain a manager, agent, etc. I will direct them to coordinate with the Queen California so that we may better coordinate all public appearances.
       
    • If I am selected as a Titleholder and I am approached to participate in any production, promotions, photographs, advertising, program, media, social media, endorsements, testimonials, appearances, etc. specifically because of being the Titleholder, then I will inform Queen California Producers of this request so they can determine if they would like to control or make arrangements for my participation.
       
    • If I am selected as a Titleholder and am approached to participate in any production, promotions, photographs, advertising, program, media, social media, endorsements, testimonials, appearances, etc. and is unrelated to me being the Titleholder, I shall still inform the Queen California Producers of such participation.
       
    • If I am selected as a Titleholder, I agree to work and coordinate with Queen California Producers as it relates to my public image and persona, including but not limited to social media, press releases, business cards, promotions and interviews.
       
    • The winner (Titleholder) of the Queen California pageant must meet the eligibility requirements of the Queen USA pageant and submit a completed Queen USA application (located on the TransNation Festival website www.transnationfestival.org), and fulfill all of the Queen USA application requirements, supporting documents and agreements by 9/30/16 in order to hold the Queen California title and to compete in the Queen USA pageant on October 22, 2016 at the Theatre at the ACE, downtown Los Angeles. (Application fee waived)
       
    • If the Queen California Titleholder is unable to submit a completed Queen USA pageant application by 9/30/16, the Queen California title and its representation as a contestant in the Queen USA pageant will be forfeited and passed to the First runner-up. The First runner-up will be then required to submit a completed Queen USA application in order to hold the Queen California title and to compete in the Queen USA pageant on October 22, 2016. If the First runner-up is unable to submit a completed Queen USA application within 3 days after being assigned as the Queen CA titleholder,* the Queen California title and placement as a contestant in the Queen USA pageant will be passed to the Second runner-up and so on.
  • APPEARANCES:

    I have read, understand, and agree to the below:

    • Appearances: Titleholder agrees to make approximately 24 or more appearances during their reign.
    • Appearance DefinitionAn appearance may include but is not limited to radio, television, newspaper and magazine interviews or other public appearances. Public appearances at events include but are not limited to: parades, charity events, fundraising events, grand openings, fashion shows, emceeing an event, judging a contest, photo shoots with crown and sash, signing autographs at events, etc.
    • Appearance ApprovalTitleholder agrees that the Queen California Pageant will be informed of all appearance requests made directly to National Titleholder. All public appearances by Titleholder are subject to prior approval by Queen California Pageant Producers.
    • Compensation and travel expenses: Titleholders agree that they will receive no “appearance fees” or additional compensation from Queen California, beyond their pageant award for any appearances, including those set forth above. If in-person travel expenses are incurred or required for participation in an appearance, they will be determined, arranged, and compensated at the discretion and approval of the Queen California Pageant. If the Appearance host or requestor is not Queen California then they may provide the Titleholder with an appearance fee, honorarium or the like and/or may agree to provide for travel expenses. However, Titleholder cannot make their participation in the Appearance subject or contingent upon receiving compensation or travel expenses.
  • PUBLICITY RELEASE FOR TV MEDIA AND PROMOTION

    • I grant to Queen California, directors, employees, volunteers and agents (collectively, “Licensees”), a royalty free, paid up, perpetual, irrevocable, worldwide license, right and permission to reproduce, publish, distribute, prepare derivative works from and otherwise use any materials that I may submit to any Licensee and my image, identity, name (legal and stage or preferred name), signature and other identifying characteristics in any format, size, or media for any purpose. My grant of license, right and permission applies to any and all rights that I may have under any and all applicable laws including, by way of example and not limitation, copyright, trademark rights and rights of publicity. I warrant and represent that I have all necessary rights and permissions to grant these licenses, rights and permissions. I agree to defend and indemnify Licensees against any third party allegation, claim or lawsuit arising out of or relating to Licensees exercising, exploiting or otherwise using these licenses, rights and permissions.
  • LIABILITY RELEASE:

    • I UNDERSTAND AND AGREE, TO THE MAXIMUM EXTENT PERMITTED BY LAW, I IRREVOCABLY HOLD HARMLESS AND RELEASE QUEEN CALIFORNIA PAGEANT, INCLUDING BUT NOT LIMITED TO THEIR OFFICERS, OWNERS, EMPLOYEES, DIRECTORS, LEGAL REPRESENTATIVES, VENDORS, ASSIGNEES, ATTORNEYS, INSURERS, CONTRACTORS, VOLUNTEERS, PARTNERS, AGENTS, SPONSORS, HOSTS, JUDGES, FAMILY MEMBERS, AFFILIATES, AND THE HOST HOTEL OR VENUE OF THE PAGEANT (HEREIN THE RELEASED PARTIES) FROM ANY AND ALL CLAIMS, ACTIONS, DAMAGES, LIABILITIES, LOSSES, COSTS, AND EXPENSES OF ANY KIND (INCLUDING WITHOUT LIMITATION, ATTORNEYS’ FEES AND COSTS) ARISING OUT OF, RESULTING FROM, OR BY REASON OF THE TITLEHOLDER SELECTION PROCESS, ANY FAILURE TO SELECT ME AS A TITLEHOLDER IN THE PAGEANT, MY PARTICIPATION IN OR IN CONNECTION WITH THE PAGEANT, INCLUDING, WITHOUT LIMITATION, ANY TRAVEL I UNDERTAKE IN CONNECTION WITH MY PARTICIPATION IN THE PAGEANT, ANY EXPLOITATION OF THE PAGEANT OR MY APPEARANCE IN THE PAGEANT (INCLUDING THE USE OF MY NAME, LIKENESS, VOICE, IMAGE, PHOTOGRAPH, AUDIO, VIDEO, CV AND/OR BIOGRAPHY IN CONNECTION WITH THE PAGEANT , INCLUDING BUT NOT LIMITED TO ITS USE IN PROMOTIONAL AND ADVERTISING MATERIAL THROUGH ANY MEDIA OUTLET), OR ANY USE OF ANY PRIZE OR GIFT AWARDED TO ME IN CONNECTION WITH THE PAGEANT, ON ANY LEGAL THEORY WHATSOEVER (INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, NEGLIGENCE, FRAUD, RIGHTS OF PRIVACY AND PUBLICITY, INTELLECTUAL PROPERTY, OR DEFAMATION) (COLLECTIVELY, THE “RELEASED CLAIMS”). THE RELEASED CLAIMS SPECIFICALLY INCLUDE, WITHOUT LIMITATION, ANY AND ALL CLAIMS, ACTIONS, DAMAGES, LIABILITIES, LOSSES, COSTS, AND EXPENSES OF ANY KIND RESULTING FROM THE ACTION OF ANOTHER CONTESTANT, APPLICANT, TITLEHOLDER OR ANY OTHER THIRD PARTY AT ANY TIME. TO THE MAXIMUM EXTENT PERMITTED BY LAW, I ALSO AGREE THAT I WILL NOT BRING OR BE A PARTY TO ANY LEGAL ACTION OR CLAIM AGAINST THE RELEASED PARTIES BASED ON ANY OF THE RELEASED CLAIMS HEREUNDER. IN THE EVENT THAT THE FOREGOING RELEASE IS DEEMED UNENFORCEABLE FOR ANY REASON, SUCH PROVISION WILL BE MODIFIED TO RENDER IT ENFORCEABLE IN SUCH A MANNER AS TO BE WITHIN THE ORIGINAL INTENT AS NEARLY AS POSSIBLE AND THE REMAINDER OF THIS AGREEMENT WILL CONTINUE IN FULL FORCE AND EFFECT. MY SOLE REMEDY FOR BREACH OF THIS AGREEMENT SHALL BE AN ACTION AT LAW FOR MONEY DAMAGES IN WHICH MY RELIEF WILL BE LIMITED TO A REFUND OF THE ENTRY FEE THAT I PAID TO PARTICIPATE IN THE PAGEANT MINUS ANY FEES CHARGED BY QUEEN CALIFORNIA PAGEANT OR ON BEHALF OF QUEEN CALIFORNIA PAGEANT’S LEGAL COUNSEL. IN NO EVENT WILL THE RELEASED PARTIES HAVE ANY LIABILITY TO ME ON ANY CAUSE OF ACTION FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR SPECULATIVE DAMAGES, IRRESPECTIVE OF WHETHER SUCH DAMAGES ARISE UNDER CONTRACT, TORT, STATUTE, OR OTHERWISE AND WHETHER OR NOT THE PARTIES HAVE ADVANCED NOTICE OF THE POSSIBILITY OF SUCH DAMAGES. I HEREBY KNOWINGLY, VOLUNTARILY, EXPRESSLY AND IRREVOCABLY WAIVE APPLICATION OF CALIFORNIA CIVIL CODE SECTION 1542, WHICH I CERTIFY I HAVE READ AND WHICH STATES IN PERTINENT PART: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR”. I UNDERSTAND AND ACKNOWLEDGE THE SIGNIFICANCE AND CONSEQUENCES OF MY WAIVER OF CALIFORNIA CIVIL CODE SECTION 1542 AND FURTHER UNDERSTAND AND ACKNOWLEDGE THAT I MAY, HEREAFTER, DISCOVER CLAIMS PRESENTLY UNKNOWN OR UNSUSPECTED, OR FACTS IN ADDITION TO OR DIFFERENT FROM THOSE WHICH I NOW KNOW OR BELIEVE TO BE TRUE WITH RESPECT TO THE MATTERS RELEASED HEREIN. NEVERTHELESS IT IS MY INTENTION, THROUGH MY EXECUTION OF THIS AGREEMENT, TO FULLY AND FINALLY RESOLVE AND RELEASE ALL SUCH MATTERS, AND ALL CLAIMS RELATIVE THERETO, WHICH DO NOW EXIST, MAY EXIST OR HAVE EXISTED, AND THAT I WILL HEREAFTER NOT BE ABLE TO MAKE ANY CLAIM AGAINST THE RELEASED PARTIES REGARDING ANY SUCH MATTERS.
  • CODE OF CONDUCT AGREEMENT:

    I understand and agree that if I am selected as a Contestant, I:

    • At all times will be courteous, polite and act in a professional manner during the Queen CALIFORNIA Pageant and while representing a state title.
    • Will be respectful of everyone’s time and be punctual to all Pageant scheduled events.
    • Agree and understand that any Contestant found publicly posting slanderous remarks on public forums will be immediately disqualified. This also includes any form of Social Media.
    • Will not leave the scheduled events during the pageant nor accept any personal invitation from a person not belonging to the pageant organization.
    • Will not in any way or at any time make comments or correspond in such a manner so as to be considered defamatory, slanderous or libelous to their fellow Contestants, judges, the Queen CALIFORNIA Pageant, staff, sponsors, or any party related or connected to the Pageant.  Any such comment or correspondence may result in immediate disqualification and revocation of title.
    • Accept that any behavior which is considered disruptive or ill-tempered before, during or after the pageant may result in immediate disqualification and removal from the premises. Such actions may also result in legal charges and/or action.
    • Agree that all issues related to the Code of Conduct and consequences for violation(s) thereof shall be determined solely and exclusively by the Queen CALIFORNIA Pageant and its Producers.  I agree to accept such determinations made by them.
  • CONTESTANTS' RIGHTS

    • Every Contestant has a right to fairness and transparency. Scores will be available as soon as possible after the competition.
    • I understand that all judges’ decisions are final.
    • Contestants also have a right to equality and not to be discriminated against on the basis of any legally protected classification.
    • Interpreters will be provided upon request to Contestants with language barriers. Request for interpreters at the Queen California Pageant should be given by September 1st, 2016.
  • Additional Terms and Conditions:

    • This agreement and the terms contained herein are a binding legal document, which shall be construed and governed by the laws of the State of California.  The venue of any dispute shall be Los Angeles County, California.  I agree to this choice of law and venue provision and agree that I am submitting to the jurisdiction of the courts situated within Los Angeles County, California. 
    • I do not have any legal obligations that would prevent or limit my participation and appearances, if I become the Titleholder. 
    • I understand and agree that upon breach of this agreement, for any reason or cause as determined by Queen California Pageant, and/or their Producers, I will surrender and relinquish all designations and titles conferred upon me, and agree to thereafter make no claim to any designation or title related to Queen California Pageant.
    • I understand and agree that all rules and regulations are subject to change, modifications, and/or additions, as determined by Queen California and/or their Producers.  Any such change, modifications and/or additions will be provided to contestant within a reasonable and timely manner.
    • I understand and agree that I will be responsible for all expenses related to the Pageant and during my reign as a Titleholder, including but not limited to competition items, travel expenses, tickets, meals, personal expenses, entry fees, parking, competition wardrobe, cosmetics, or other items. 
    • I understand and agree to not use or disclose to any party information or trade secrets obtained or learned as a result of my appointment as Titleholder and/or participation in the Queen California Pageant, nor will I authorize others to do so.  This includes but is not limited to contracts, documents, forms, pageant procedures, sponsor information, judge’s information, vendors, and hosts. 
    • I understand and agree that Queen California, its respective officers, directors, employees, volunteers and agents are not responsible for any accident, injury, or illness incurred or suffered by me in travel to and from Queen California Pageant events, while making appearances as a Titleholder, or at the Queen California Pageant itself.  In the event of an accident, injury or illness, which may necessitate medical care or treatment, I understand and agree that I will assume all monetary responsibilities.
    • I understand and agree that Queen California is not responsible for any actions including negligence or fraud on the part of the host hotel, any venue, sponsors, or vendors.
    • I understand and agree that Queen California, TransNation Festiva and its respective officers, directors, employees, volunteers and agents are not responsible for any lost, misplaced, or otherwise claimed missing property during any activity, pre-competition, or competition activities. 
    • I understand and agree that I will be responsible for all taxes and other obligations that are or may become due as a result of my receipt of any prize(s) or other compensation in connection with the Queen California Pageant.
    • I understand and agree that by submitting this application I have been given sufficient time to review this agreement and its terms, and I understand I may consult with an attorney of my own choosing and at my expense to give me legal advice concerning this agreement. 
    • I understand and agree that this agreement is a legal document and that if I sign and submit it electronically, it will create legal obligations that will be binding on me.  I understand and agree to be bound by this agreement even though it may be only signed and submitted electronically.  In addition, I understand and agree that I may be required to also sign a hard copy of this agreement and other documents if I am selected as a Contestant and I agree to do so promptly.
    • I understand and agree that I may be required to sign additional agreements and documents in connection with my participation in the Pageant. If it is determined necessary by Queen California Pageant and the producers, I will not withhold my signature or approval.  
    • I understand and agree that if any of the terms, conditions, provisions, rules or regulations contained in this agreement is declared to be illegal or void or unenforceable, the remaining terms and conditions will continue to be valid and in full force and effect.
    • I hereby affirm that the statements made in this agreement are true.  I am aware that if any statement is willfully false, I am subject to disqualification and/or forfeiture of prize(s) and/or award(s) without refund, in full or in part, at the sole discretion of Queen California and/or their Producers.
    • I understand and agree that this Agreement may ONLY be amended or modified by a written agreement executed by each of the parties.
  • HAVE READ, UNDERSTOOD, ACKNOWLEDGED, AND AGREED TO THE ABOVE MENTIONED TERMS, RULES, CONDITIONS, AND CONTENTS OF THIS APPLICATION. I HEREBY HOLD HARMLESS AND WAIVE ALL RIGHTS OR CLAIMS AND LAWSUITS OF ANY TYPE AGAINST THE JUDGES, VENUE, AND PRODUCERS INVOLVED, OR ANY INDIVIDUAL WHO MAY WORK FOR THE AFOREMENTIONED. I UNDERSTAND THAT ANY PERSON OR SPONSOR ASSISTING ME IN ANY WAY IS ALSO BOUND BY THE TERMS OF THIS AGREEMENT. BY SIGNING THIS ELECTRONIC DOCUMENT, I CERTIFY THAT ALL OF THE INFORMATION SUBMITTED BY ME CONTAINED IN THIS APPLICATION IS TRUE AND CORRECT.
